Mediation and Conflict Resolution

Mediation is a form of conflict resolution that uses a neutral person to assist parties in resolving their disagreements. The goal is to ease their tensions before they escalate into situations that may cause damage. Using a more informal and flexible process, attorneys are not necessary, as it differs from disciplinary and grievance procedures.

When parties or organizations attempt to resolve a conflict by proving who is right and who is wrong, they end up being impassed. That is why so many disputes have landed in court. A different strategy for resolving disputes is to engage an expert mediator who focuses not on rights but on interests that may influence both parties' needs, concerns, and desires. Therefore, an interest-based mediator is not necessary to fully understand the technical details of the problem. Importantly, an interest-based mediator must be a fast learner, quickly grasp the fundamental knowledge of causes before discussing the subject matter, and help both parties resolve complex technical issues as swiftly as possible.
